selling my wheels to local girl...NEED feedback
well..im selling my wheels..finally..i will miss them....NOT!!!(borat).
Anyways..the best way to do this is to sell them to her with her making payments over a year. $70 a month equaling out to $804 in the end. BUT..here is the thing..i wrote a bill of sale...not only that but im REALLY good friends w/ her boyfriend. Now here is the worst part..shes putting them on a green v6'er Firebird..yes I know its going to another firebird..im sorry lol.
But anyways I wanted yalls feedback on this Bill of Sale that I wrote..tell me what you think
Bill of Sale
BE IT KNOWN, that for payment in the sum of $804.00, the full receipt of which is acknowledged, the undersigned _____________________________________ (Seller) hereby sells and transfers to _____________________________________ (Buyer), the following described item(s). (Pacer Sunburst wheels/tires)
The sale is subject to the following conditions:
Seller acknowledges receipt of $70 in down payment for the wheels starting on this day of_____________-2007, full payment from the Buyer to take place within 365 days. (1 year) of the first down payment.
Seller allows the Buyer 365 days to have the wheels/tires paid in full.
If the payment is not received by the pay period of the buyer and/or the end of each month, the seller retains the right to repossess any and all items given to the buyer that he/she is purchasing from the seller. These items include: wheels, tires, center caps, lug-nuts, wheel locks.
Seller certifies to the best of the Seller's knowledge that the conditions of the wheels/tires are in perfectly normal operating conditions. Have no physical or hard to see defects, or any defects that can potentially cause liable issues to the buyers vehicle. However: The seller is not liable for any damages caused by this item being sold. It is the buyers own risk as to how they take care of this item(s). Buyer still pays seller full price.
Buyer warrants to Seller that Buyer has good steady job and will be able to make the payments on demand to the Seller.
Seller has no knowledge of any hidden defects in and to the items described above, and believes to the best of the Seller's knowledge that the items being sold is in good operating condition. Said items are otherwise sold in “as is” condition and where currently located.

x2 tell the broke ass bitch to save her nickels until she can pay you in full!
also in your bill of sale put something in there that she is not allowed to sell them until they are paid off or something like that... if she sells them and says fuck you, then how are you going to repo them..

Good luck with that, but I'd add in the size of the wheels/tires and the brand model of tires too and remaining tread depth in case she doesn't pay and you can get your money if you need to go to court. Make sure you take pics and get them developed right before you hand them over for they have a current date stamp on them from a photo store. Staple a copy of the pics to the bill of sale to prove condition too. You might want to add a DL # in for you can prove it's really her. I've ran across many shady people and you want to cover your ass if you don't want to pay. Just getting cash up front solves so many issues.

thanks man...i think it will be okay..if not ill repo them VERY quick..sorry guys but I am doing it. I really need these gone and this is the only person that wants them around here. So I have to do it...im putting some stock chrome Z28 wheels on the hawk until I get my new wheels (another friend letting me borrow them)

MISTAKE, dont do it. Make her pay it all up front. You aren't in the credit business my friend. Dont get hosed...
On a positive...good that you have a Bill of Sale drafted up. If you follow through w/this make 2 copies and have her sign both. Give one to her and you keep the other...
BTW, most if not all Bill of Sales drafted by the selling party never need to be notaized, unless stated by law. The buyers signature will hold up just in small claims court...

The other option is continue to take all the payments but do not giver her the wheels until it is paid in full.

that to me says that you received $70 up front,she takes wheels...but can stiff you for the rest of the time until the end of 365th day.
You need to put down something that says "agrees to pay $70 a month thereafter"
I wouldn't do it..ppl stiff credit card companies and each other all the time..she could save up some cash if she would cut down her probably $200 cell phone bill, or spending $4 for some starbucks shit..etc.
If you have a friendship now, this is one way to possibly screw that up too..maybe get something of value for collateral of hers or partially trade for something?
Piece of ass may knock down the price slightly
besides..what you gonna do to repo them? Sneak over at night and jack it up?

DON'T DO THIS.
What happens if they break up? What happens when she skips a payment, are you going to go all on your buddy and/or her? If you have to start chasing her for payment, is he going to get pissed?
More bad things can happen that making 800 bucks.
Aint worth it.
