In answer to the OP's original question -- I tried to get text messages from Verizon for use in a case. Next to impossible as they purge everything from storage every 3-4 days. By the time you get a subpoena signed and served the messages are already gone.

State laws vary in divorce cases. Some states require you be a resident at least 6 months in that state, some require a specified time of separation (living apart, or living within the same house but staying in different rooms, etc.)

The only way to know is get a lawyer on retainer. Even if you don't go through with it, at least you'll know the facts and can better prepare yourself.

My brother is one who requires quite a bit of that sort of legal support.

Excellent suggestions. Once the doubt and trust issue is put into your mind you will never get it out. Definately get your ducks in a row quickly before mentioning anything to her. It may seem wrong in your mind but your protecting yourself and setting yourself up for a better future! This is coming from one who has been there first hand and seen many of friends and my own parents go through the same!
