I also talked with my neighbor who is an Asst Chief of Police, gave him all the details, my actions and the jerks actions, didn't hide anything; his answer = I was legally correct and correct in my actions.
Without seeing the situation or me posting an overview of the parking lot and side road (Which I'm not going to do just to prove my argument) you might think I had an escape, which I didn't. He WAS blocking my vehicle, I COULD NOT ESCAPE because said vehicle was blocking me and the fact that I AM CRIPPLE compounds my ability to escape. So by Castle law in AL I am still in the right.
Again you might not be getting it, I REACHED FOR MY PISTOL, I DIDN"T DRAW IT IOW I placed my hand on it in preparation to draw it. NOT ILLEGAL anywhere, except maybe NY, CA, and WA or any other commie states we have
As far as me daring him, what I did was asked him a question. It was my way of telling him firmly in a round about way to make the smart choice by moving on.Last edited by SMWS6TA; 07-16-2009 at 05:10 AM.

You do realize simply telling someone "come one step closer and I'll kill you" can be grounds for arrest, loss of CCW, and many other legal problems right? You did what you did and that's a done deal. But in a time when the law isn't so clear on many things anymore, you slipped by a possible ugly situation. Now with that being said, I don't know what/how the laws apply in Alabama but here in Lousiana, you would have been the one taking a ride in the back of the car with the cool flashing lights.
And just for clarity...
Wife = works at a law firm
Her dad = City cop
Her brother = City cop
God father = Major with the State Police
So her entire family is essentially in law enforcement on some level.

He is wrong, and you need to worry about taking advice from him later on.
You dared him to come at you. You made the threat to his female if he continued he would be dead. You both were barking behind the steering wheels of cars neither had removed themselves from the vehicle. You were not blocked in and stop trying to change the story as you go a long. You make responsible gun owners look bad when you act like you are in the wild west.
You would have been fine had you not dared him to make a move.

Because the original poster is the people that ruin it for gun owners. There is a reason we have such strict rules and its because people who get a gun somehow think they are cowboys and can make threats.
You are either in danger, or you're not. In his situation his life was not in danger at ALL. If my life is in danger im not giving the guy knowledge i am armed, and i certainly will not dare them to up the fight.Last edited by Bigrus; 07-16-2009 at 09:35 AM.

1st I am not changing the story. As you ask questions I answer them. When I first wrote OP I may have left out somethings like, there were 4 cars behind me, one was green, the other tan, etc, another thing like, I could not turn out of said parking lot because oh lets say forward and left were block by his truck, couldn’t turn right because of parked car. This leads me to -
2nd You were not there! If police had been call their judgment of all the factors would have come into play. I am trying to describe the situation as it had happen. If you want pictures of said intersection of parking lot well here you go: http://maps.yahoo.com/;_ylc=X3oDMTEx...134796&zoom=19
Just zoom in on the cross hairs…Pre-disclosure It is a Yahoo map; it may be 5 yrs old and doesn’t reflect today’s car traffic at 1200 CST.
3rd You just can't seem to grasp the point. Re-read OP, I reached, did not say brandish. Again nothing illegal about that!
4th I’ll agree we were both barking as you put it. However my “bark” wasn’t directed at his woman, it was directed at him. Again re-read OP. If some SOB starts screwing with you are you going to coward down and take it? BS, carrying or not carrying I still wouldn't have put up with that. I don't walk around thinking I a badass. Read next statement why
And last -
Agree, However unless you are talking about being a Dallas Cowboy Fan (Which I am) I wasn’t acting like one. This is where experience over theory comes into play. I have 16 yrs Military (Active Army) training and experience. I’ve been in combat 4 times totaling about 4 yrs. I think I can recognize a situation developing into a hostile one.
What is your experience? Have you ever been attacked or had a family member been attacked in front of you? Because you are in TX, I know you attended a CCW class if you are carrying. Did your instructors teach you about safety zones - you know the ones where if an attacker is within x amount of feet from you, you have this much time to react? If not, you need to read up on this stuff. Any attacker can close a distance of 15-20 feet in 2 seconds. How fast can you react to that? There was nothing stopping him from drawing a gun himself, and blasting me, and driving off. Now what does your theory state? I’m not saying I would have been able to do anything in that situation, but you never know what ppl will do as the come up on you.
You seem to keep applying TX state law to something that happens in AL. I see you are not going to accept anything else I state on this so let’s agree to disagree…

Then you should know its not hostile by your wording alone. Regardless of the talk you should know he was not going to walk. Also stop using your service as a crutch. I respect those who serve, but cannot handle them using it like the end all of an argument. We both know idiots can join the army just as idiots can go to college.
I have, and with my ex line of work i was a prison officer before. Now i work in medical. I know when someone is a threat, however guessing someones moves is just that a guess,
Yes, and no one had crossed yours.
If they are no obstructions, and they do not have to get up and out of a car.
[QUOTE=SMWS6TA;1994877] There was nothing stopping him from drawing a gun himself, and blasting me, and driving off. Now what does your theory state?/QUOTE]
You just made my point. You reached for the weapon before a threat on your life was made alerting him to what you might have had. Then instead of letting him make a move you alerted his female to what might happen. Now if the guy did have a gun and a ego to fill you would be in a gun battle with him. Shooting through his female to get to him.
Again you were all clear until you made your threat. I was totally with you until you made the threat which becomes a dare on your end.

Agreed. I'm not in TX or AL, but in VA there was no reason for you to pull your weapon (I know, you didn't, yet...bear with me). Once you verbally threatened him with the fueral phrase, there WAS a reason for him to pull his. He could well have BEEN fearing for his life! You just said you'd kill him, and presumably reached for a gun. Now, he's got every right to pull on you. If that happened, two things could have come of it:
#1-you shoot first. Downtown, since you're sticking to your story, and her story goes along with it, YOU threatened HIM. Uh-oh!
#2-He shoot first. Both of them say you threatened him and went for a gun. Uh-oh!
Either way, you have no legal leg to stand on. You acted before you thought, seems to me.

The way the other guy is comming off, I don't think it would have mattered what he said, the guy was going to escalate. I would have said something like, "Quit smoking all that pot with your whore girl friend, it's making you paranoid". Then wait for him to step out of his car, at that point I would jump out of my car and just chase him down and go ape shit on him.
In fact, I probably would have pulled me cell phone out and started taking MORE pictures. It's completley legal, popuratzi do it all the time. I've been itching for a good fight latley and this guy just sounds like the type I'd love to level.
And the only threat he made was your gf would be attending your funeral. He NEVER said he had a gun. Never brandished it. Never implied which method he would kill him by. Or even said he would kill him. Maybe he meant if he got out of the car lightening would strike him dead. If it isn't black or white, whose to say waht's in the gray?

You are not much younger then me but i guess we are light years on maturity.
1. You chasing someone down and beating them makes you the criminal.
2. If you go by the facts when you say "She will be attending your funeral" while reaching for a weapon you just made a threat. Regardless if he pulled it or not if someone called the local P.D and said thier life was just threatened he will be guilty since he has a weapon in his car.
