    Internet Sale Question

About two months before Thanksgiving, I advertised that I was looking for a set of Black ZR1s with at least 2 17x11 wheels. After about 2 weeks I got a PM from a member here telling me he had a set of used Black ZR1s (2 17x9.5 and 2 17x11) with crappy tires (I was thinking about using them for burnouts before I put good tires on them). We PM'd back and forth for a few days negotiating a price (settled on $300 + shipping). When I asked what address I should send the check to, I realized he was located only 4 hours from my fiance's parent's house in Indiana. Since I was going to visit her parents for Thanksgiving, I told him I would come pick up the wheels the day after Thanksgiving. He said this was fine as long as I sent a 50% deposit ($150) to hold the wheels for me, which I did.

Fast forward to the weekend before Thanksgiving. I emailed him to confirm that we were meeting up at his house on Friday. He replied the morning I was leaving Maryland for Indiana (Wednesday) saying that he completely forgot but would have the wheels ready for me when I got to his house on Friday. Thursday night rolls around and I email him telling him that I would be at his house around 10am the next morning. He emails me back saying that the wheels are still on the car and that he might not have them off in time. I say that as long as he has a jack and lug wrench, I would be ok taking them off myself. He said this wouldn't work cause he would be in Chicago working, but would be willing to meet me on his lunch break (still a 4 hour drive). Long story short, I say I'd rather not meet cause of too many complications and he offers to ship them to my house. He said he would ship them and when I got them I whould send him another check for $100 (total of $250).

Well, now Christmas has come and gone and I still have not received the wheels. I emailed him Wednesday (Christmas Eve) and he has not replied yet.

Here is my question...I'm done dealing with this and just want my $150 deposit back, how do I legally go about getting this back?

pm me his user name and I'll try to contact him also and see if I can help. These situations are pretty tough. You have 1 good thing going for you....you know where he lives. I would do whatever you could to try and work it out with the guy and keep it civil. Getting pissed and sending threatening stuff is really tempting in these situations but it never helps no one. Keep it civil and offer him a way out and hope that he takes it. Chances are your money is spent and you can kiss that goodbye. Now you just have to figure out how to get your rims off of him.

Take him to small claims...hopefully you were smart enough to write a check so there's a paper trail.

Well it is the holidays. I know that people are out of town till after the New Years. Since he gave you his address, its possible he is not scamming you. But you never know.

I understand that, hence why I'm not going around saying he's a bad guy or trying to smear his image. I just want to know what to do in case this urns out to be a bad thing. It's only $150...I'm not going to get bent out of shape about it.

    then send me $150

I sent a PM to him and we'll see if we can get it worked out. T-giving to x-mas is plenty of time and if you guys had an agreement that you would come by t-giving to pick them up then he should've held up his end of the deal. Did he say for sure he would have them off the car by then or did he say he would try to?

He is out trying to catch Ed's car parts returning to earth. He will return shortly. If not we will go beat the shit out of him.

I was under the impression that they were off the car from day one...I was surprised when he told me that they were still on the car.

that's the point that shouldn't be missed. There was a pickup arranged between these guys that wasn't honored.
