After eatting lunch, leaving parking lot, had some asshole come pull up beside me, I start looking hard at him because he is in the incoming lane, trying to turn left in front of me. Then he lowers his window and starts yelling

"Whatz ur name?"

You do realize your last line of the conversation can make you lose your CCW? Do not make a threat with your weapon. Use it in a situation where you are in fear for your life. That means not reaching for it until he is out of the car, and it also means not telling him he will be shot if he continues.

You are pretty much giving a cop a reason to remove your weapon when you make threats with your weapon and there is no real danger.

Looking at my OP I see how you might have thought I flashed my pistol, let me clarify: 1) I was still in my car and 2) “I reached for it”, placing my hand on my pistol doesn’t mean I flashed it. I saw the situation escalating. It takes less than 2 seconds to draw a gun on someone and less than that to pull trigger. I didn’t know what this A-hole was going to do and when he made the threat of physical harm, I am clear to defend myself.

I am a cripple; I must use a special crutch to walk short distances or a wheel chair, so this means I can't defend myself like a healthy person can.

One may constitute that I made a threat; I was only stating a fact. I am professionally trained in firearms and have a few yrs of combat experience, so I see threats different than the average Joe on the block.

I am all for people who take the time and get trained to have a CCL. Who is to say you were not in fear fo life. But he had a gf in the car. My question would you take her out also? (I know you wouldnt) Could she not say they feared for theirs?

The problem is if the few posters who in this thread cannot agree with your actions a court is not going to.

You had means of escape he was not blocking your vehicle, also you made the threat he would be in a grave practically daring him to try something.

I am all for guns for protection as i do carry myself. I am not for someone with a weapon daring someone to make the next move. In this situation you would be 100% fine if he was a threat however he was not. It does not take a trained eye to see you both were just barking through the fences.

I also talked with my neighbor who is an Asst Chief of Police, gave him all the details, my actions and the jerks actions, didn't hide anything; his answer = I was legally correct and correct in my actions.

Without seeing the situation or me posting an overview of the parking lot and side road (Which I'm not going to do just to prove my argument) you might think I had an escape, which I didn't. He WAS blocking my vehicle, I COULD NOT ESCAPE because said vehicle was blocking me and the fact that I AM CRIPPLE compounds my ability to escape. So by Castle law in AL I am still in the right.

Again you might not be getting it, I REACHED FOR MY PISTOL, I DIDN"T DRAW IT IOW I placed my hand on it in preparation to draw it. NOT ILLEGAL anywhere, except maybe NY, CA, and WA or any other commie states we have

You do realize simply telling someone "come one step closer and I'll kill you" can be grounds for arrest, loss of CCW, and many other legal problems right? You did what you did and that's a done deal. But in a time when the law isn't so clear on many things anymore, you slipped by a possible ugly situation. Now with that being said, I don't know what/how the laws apply in Alabama but here in Lousiana, you would have been the one taking a ride in the back of the car with the cool flashing lights.

And just for clarity...
Wife = works at a law firm
Her dad = City cop
Her brother = City cop
God father = Major with the State Police

So her entire family is essentially in law enforcement on some level.

You dared him to come at you. You made the threat to his female if he continued he would be dead. You both were barking behind the steering wheels of cars neither had removed themselves from the vehicle. You were not blocked in and stop trying to change the story as you go a long. You make responsible gun owners look bad when you act like you are in the wild west.

Because the original poster is the people that ruin it for gun owners. There is a reason we have such strict rules and its because people who get a gun somehow think they are cowboys and can make threats.

1st I am not changing the story. As you ask questions I answer them. When I first wrote OP I may have left out somethings like, there were 4 cars behind me, one was green, the other tan, etc, another thing like, I could not turn out of said parking lot because oh lets say forward and left were block by his truck, couldn’t turn right because of parked car. Agree, However unless you are talking about being a Dallas Cowboy Fan (Which I am) I wasn’t acting like one. This is where experience over theory comes into play. What is your experience? Have you ever been attacked or had a family member been attacked in front of you? Because you are in TX, I know you attended a CCW class if you are carrying. Did your instructors teach you about safety zones - you know the ones where if an attacker is within x amount of feet from you, you have this much time to react? If not, you need to read up on this stuff. Any attacker can close a distance of 15-20 feet in 2 seconds. How fast can you react to that? There was nothing stopping him from drawing a gun himself, and blasting me, and driving off. Now what does your theory state? I’m not saying I would have been able to do anything in that situation, but you never know what ppl will do as the come up on you.

You seem to keep applying TX state law to something that happens in AL. I see you are not going to accept anything else I state on this so let’s agree to disagree…

You just made my point. You reached for the weapon before a threat on your life was made alerting him to what you might have had. Then instead of letting him make a move you alerted his female to what might happen. Now if the guy did have a gun and a ego to fill you would be in a gun battle with him. Shooting through his female to get to him.

Again you were all clear until you made your threat. I was totally with you until you made the threat which becomes a dare on your end.

Agreed. I'm not in TX or AL, but in VA there was no reason for you to pull your weapon (I know, you didn't, yet...bear with me). Once you verbally threatened him with the fueral phrase, there WAS a reason for him to pull his. He could well have BEEN fearing for his life! You just said you'd kill him, and presumably reached for a gun. Now, he's got every right to pull on you. If that happened, two things could have come of it:

I would have said something like, "Quit smoking all that pot with your whore girl friend, it's making you paranoid". Then wait for him to step out of his car, at that point I would jump out of my car and just chase him down and go ape shit on him.

In fact, I probably would have pulled me cell phone out and started taking MORE pictures. It's completley legal, popuratzi do it all the time. I've been itching for a good fight latley and this guy just sounds like the type I'd love to level.

1. You chasing someone down and beating them makes you the criminal.

2. If you go by the facts when you say "She will be attending your funeral" while reaching for a weapon you just made a threat. Regardless if he pulled it or not if someone called the local P.D and said thier life was just threatened he will be guilty since he has a weapon in his car.

She turned him in to the bosses, and the cops were there in 15 minutes. She didn't end up pressing charges on him, but he lost his job for making the threat. Sure, this is an extreme example, but if they got your tag number and they turn you in, welcome to being screwed...ESPECIALLY if they say you reached for something as you made the threat, and the cops see you have a concealed permit. They'll put 2 and 2 together, just like folks in this thread are doing.

As a CCW myself, most of the OPs actions seemed ok until the "death threat" comment. That should have been left out. Deadly force is the last option and should be used only then. A retreat would have been better but given the details, that may not have been a option due to a handicap. His pistol should have been on his person also, that way when he got out of the car to retreat, the pistol went with him incase it got worse. I have not had to pull mine yet but will give a much better warning before hand. A retreat will make you look like a puss but better than a long drawn out, expensive, court trial.

You don't think cops are going to go light and be friendly? I have a friend with two jimmy crutches, he can walk but not to good and he loses balance a lot. Anyways, he has a handicap liscense plate. Everytime he comes to a checkpoint cops run from time to time. They waive him through every single time. They don't smell his breath or anything half the time. Just wave on by.

No, and again they will check and realize he has a weapon in the car further putting guilt on his shoulders.

Regardless of his service many officers are on higher alert when it comes to weapons and death threats. Sadly there have been some people who have come back from war only to kill civilians. Regardless of their duty you need to look at state of mind and the evidence at the time.
