The whole case is funny though because both parties know not a cent just about is going to get paid! Why charge one if you can't charge all offenders?
Just another lost cause to add to the bin.

I'm with you on this one Shady.. Me and my son had this exact conversation..
I told him.. next time you volunteer to work a few days a week for free for say Oh four months... and everyone that shares your music does the same.. I will agree with you that it should be free...Oddly, not one of those kids has volunteered to work for free.. Damn strange that.

well, as you can probably tell, i don't consider it stealing. it's copyright infringement. if she stole it, it would no longer exist in it's original place - it would be in her possession, and she'd have control over the property. if she takes a cd from the store...that is stealing, it no longer exist in it's original place. but this is copyright infringement...she copied the music to her computer, but the original file still exist...from where ever she got it from. still a crime, because there's a law against it.
in my mind, it's like taking a picture of a painting in a museum (not sure if that's illegal?)...but that would be a copyright infringement. stealing it would be that she actually stole the painting.
maybe it's a flawed analogy, but that's how i see it.

that's way past excessive. as someone else said this is one of those things that i have come to hate about the U.S. you feel even the least bit slighted all you have to do is sue and you'll end up with hundreds of thousands or millions of dollars in compensation for something dumb as hell.

The biggest issue I have is, is it stealing if the song you are "stealing"/downloading played on the radio? Isn't it the same as hitting record on your old cassette boombox when the new pearl jam song came out?
