    So I had to come in to work at 2pm and didn't have time to take the papers to my insurance so my mom went ahead and took them to a lawyer to see what's up. Well he said most likely what happened is that this lady didn't get any money from her insurance or mine so she's trying to get it from me. So I have to go tomorrow and take the papers to my insurance so they could look it over and give me a lawyer or settle it with her and it'll all be over hopefully.

    No one suggested it yet, but you may want to look into hiring a PI if you're pretty sure she isn't injured. If he can get footage of her walking/lifting, etc. without issue, it may come in handy.

    If it settles out of court you may be able to use it to negotiate the amount down, or better yet if she comes hobbling into court (and your lawyer admitted video footage as evidence) showing her walking without issue, the judge may just throw it out.

    For all those posting with the exception of the OP (because it's too late), this is why Umbrella coverage is so important.

    Last night talking with my dad, he was telling me about how insurance companies are busting more people pulling accident scams.

    Basically they stop short in front of another driver and get slammed. Then claim the usually neck/back pain and file suit. Cops are getting into investigating them more.

    Might want to check into this.

    Well I took the papers to my insurance agent and she faxed them over to the higher people and she said they would call me later to see what's up. So now I wait for the call. If this does go into court then I just might do the PI thing but then I also have people willing to testify that they have seen her just fine, if that helps any.

    Have someone take pictures of her doing things that she should not be able to do if she were truly harmed. Make sure the person who takes the pictures is willing to testify if needed. If you have absolute proof her claim is bogus it will not go to court.
