Ive dealt with warranty companies, and with such a big claim...
im so sorry to say this, but your mods VOID the warranty fair and square. there is prolly little to nothing that you can do, i know that SUCKS but they look for ANYTHING to void a warranty, it doesnt matter if you bought it that way or not, even if you did... the salesman should have not sold you a warranty because he would have known those mods would have made the warranty VOID.
When my rear went, i had a car club STICKER on my back windsheild, we almost took it off because warranty inspectors will deni a claim stating like "suspect drag racing/street racing with vehicle which may have caused the break". a STICKER would make them suspect something like that..
Im really sorry.... even if the fuel pump did cause the motor to seize you would need one HELL of a warranty for them to cover that, im thinking bumper to bumper factory, with an aftermarket warranty with something like that, you're in trouble. sorry
As far as the option you suggested, I honestly would think about it. going after them in court is going to cause you A LOT more money then it will even be worth. Its going to drag on for a very long time causing you more in lawyer fees then the damn motor would cost.
Personally, Id shop around for a motor. You could go rebuild kit as long as the block is still good, go with better heads and so on... maybe you should take this oppurtinity to really beef up your motor... and id definitly take the deal that the dealership pays for the labor, i have rarely EVER seen a dealership offer something like that... i'd take it and run. Maybe the shop would even give you a discount on the parts, and charge the shit outta the dealership for labor to make up for it!? if its a cool shop with good guys...they will take care of you and make sure that damn dealership pays as much as possible

thanks for the harsh reality, Ash. Things are in motion now. The whole block is toast, internals too. Had to buy a used stock engine. The shop i'm working with is cool, originally they were going to do me up a 383 with the warranty money but that all changed when it came out of my pocket.
and yes i plan on upgrading the oil pump-looking around at options right now

well good luck! i hope it all works out for you, and ps next time dont even bother with an aftermarket warranty... nine times outta ten you dont even use the warranty, and when ya need it they wont cover it... the only reason i got good use outta mine was because i worked at the dealership that fixed it under warranty (had a guy who knew the ins and outs and got me covered on like everything) or my dad fixed the car and i finagled with the warranty... i hate hearin people got ripped off...

Glad to hear you have a fix, however shitty the results were. I still demand the dealer refund me the $$ for the warranty, since they sold you a bogus warranty.

it's official, i'm going after both. Another member has volunteered their legal power in my defense and I'll leave it to them to make light of themself if they so chose. But i gotta say, this is the BEST line EVER!

dont take shit, and then with what ever you get out of settlement if you are either rebuilding or putting a new one in, add some fuckin ponies bro. Yeah you'll not have that stupid warranty anymore but at least you'll know your engine is new.

dude thats horse shit, they should at the very least, be refunding your 1400 for the warranty, installing a new motor for free and maybe charge you some sort of betterment between the cost of a new engine and what yours was worth with the mileage it had. That 1400 would have went a long way towards a motor.
I hope you get some justice, i hate seeing shit like this happen to honest people!
btw most shop rates where i live are 110-150/hr so at least you are getting off somewhat easy in that respect

Don't let the swing lift incident repeat itself, stay on these guys until you get what you came for....don't let them run you over. Now that you have legal aid, just make sure you consult that person about every tiny little thing. Take notes on phone calls, write down times for everything and at least paraphrase what is said. If this legal aid is near you, take them with you when you go to the dealership. Don't take ANY crap whatsoever, and don't think for a second this will be easy, those guys probably have a mound of cash reserved to fight just this type of incident. And they're snakes....don't expect the whole truth from them....
