In our area, they start with field sobriety testing, maybe do a breathalyzer, and then transport them to the hospital for a blood draw. If a person refuses a blood draw they are still charged with DUI and get an additional one (1) year suspension of their license.

Same here. Down a pint of Jack in front of the Cop with the keys out of the ignition and he cannot prove you drove drunk. He has absolutely no choice but to charge you with public intoxication. PI carries a $75 dollar fine and no record here. It always is differed adjudication and you pay the fine.

Problem with that sarge.......alcohol takes 20 min to get into the blood stream so if the cop hits you up instantly after the stop, a good prosecuter can pin you with a dui

Wrong buckwheat. How does the prosecuter know if you were over the limit before the cop stopped you? Any defense attorney (from experiance here) will tear that shit up.
Cop cannot draw blood on the scene....without your permission.

Did as a knucklehead kid. I dont drink and drive. Havent for many years now. It saved my ass numerous times when I was an animal with my head up my ass. Most cops just impounded the car and wrote me a ticket for PI. My record is pristine

The cop has a reason for stop ie swerving, over the line, etc.... Then he hits you with a fst and breath check within 20 min after seeing you down booze. Its iffy. Sorry for spellin and grammer, its from my phone

I had a guy wreck after drinking and someone gave him a ride home. The police found him in the shower drinking a beer, with several empties on the floor of the shower. No way to prove he was intoxicated at the time of driving. No DUI charges.
