Update:

I went on a plant tour this past Wednesday. Interviewed with HR. After the tour they made me an offer. It was 6K less than what I went in at, but I went in high. After talking about the offer I sat on it about 6 hours. I accepted over the phone. I then gave them a start date.

The next day I told me boss I was going to be officially resigning on Monday. He didn't have a lot to say about it other than I should go talk to HR and let them know, so I did. She was shocked to hear this and immediately asked why and what she/they could do for me. I had a short conversation with her and she went into the details of what was involved with leaving.

During this, she explained to me that I signed a non-compete for 2 years and wouldn't be able to work for a competitor for 2 years after resigning. I asked her for my paperwork concerning it and she gave me the code of conduct and company policy about proprietary information. I reviewed it all this weekend and nowhere in there does it state this.

I called a few friends and they all exclaimed that they cannot keep me from going to work for a competitor. They also told me that non-compete agreements are not enforceable by law these days, especially since it is not even the same job scope.

Now for the ticker...

My boss went and told the GM of the company (current employer) about me. The GM called me in his office and had about an hour long conversation with me. After telling him my concerns for leaving and what it was I was looking for, he told me to give him until TR to counter-offer. He has a new role within the company he wants to create for me that will not only give me higher compensation, but also mold me into a better business savvy employee which will help me move into the position of GM in time - this is my long-term goal.

So, now what the fuck do I do? Wait and see?

I have not officially signed anything so I am not obligated to leave yet.

I have had reservations about the other job since day 1 because of the amount of travel, so this is really getting interesting now.

Shoot me your thoughts on all this.

If they shoot you a comparable counter offer, stay. It means they obviously find you very valuable, and if it is exactly what you are looking for with less travel involved, there is no question. See what they offer. Could even bring a second offer from the other company as well. It's never bad to be fought over

Could you maybe push back your start date for the new place?

Maybe a few weeks/months? All they can say is no really.

Tough call I am sure.. Do you think your current employer will actually come through?

I mean they did leave you feeling like you were going nowhere for a while.

Maybe counter with a boost in compensation requirements and see if they will work with you.

Maybe you and they (current co.) can come to some sort of compromise that will still satisfy your needs.

I see this as the ball being in your court on two fronts. But I guess it can feel like a two edged sword in your dilema too.

The GM asked me to push it back to give him more time to put something together for me. Ultimately, I feel it's up to the VP, not the GM though. The VP is from another company we acquired so he's not an original employee of our business so I'm not sure how he's going to feel about the whole thing. Guess time will tell.

I think the GM is taking the lead on this because of what you've mentioned. The outside firm doesn't know your history as well as the GM does -

When does the other company want a firm answer of acceptance, or decline?

Timing is everything. Since they know you are interested in more, and are willing to leave to get it - they know they have to do something if they intend to keep you. It sounds like they want to put something together, but I don't think they have put much thought to it until you've brought this to light. Now they're scrambling, trying to 'create' a position for you. It's not a terribly bad thing -

I know that I've been in the same boat as your employer has - and I have created positions for people in order to keep them. I reacted the best I could, and in most cases, I've been able to keep them from leaving for another job elsewhere. One thing to be sure of, is that your bosses can't read your mind (not bashing you, and am sure you know that), so that they would be thinking about your future, and what direction you want to go. Not everyone has the same aspirations. Keep the lines of communication open.

I'm interested to see what your current company comes back with - I'd like to know. Maybe I can learn something from it.

But in the looks of things explain to them not pushing that you have given you day and that an answer is needed by then if not you will have to possibly move on. They might be stringing you along like someone else has said but to the possibility that you lapse on your new company and they withdraw their offer now the old company says ah yeah sorry but no new role to mold you into the savy new position that they were saying and your shit out luck. So unless you can get something in writing that is agreed upon. Broaden you horizon with the new company.

looks like the decison has been made - i was just going to say that once you put the ball in motion (i.e. secured another job), it's probably best to follow through - you've made a commitment to the new employer, and reniging over a bidding war would certainly burn a bridge (and your integrity) - so, i think you did good on this!

just remember the grass always looks greener on the other side, ...until you get there sounds like you were a great employee and well-liked at your old place, being they tried to keep you there - take that as a compliment and try to leave w/ good relations... don't burn any bridges, ...it's not unheard of for folks to leave a complany and go back later... good luck!

Note to self...do not go into a new job on the first day on only 3 hrs sleep...when the drive is 1.5 hrs each way...and you have orientation all day
