About two months before Thanksgiving, I advertised that I was looking for a set of Black ZR1s with at least 2 17x11 wheels. After about 2 weeks I got a PM from a member here telling me he had a set of used Black ZR1s (2 17x9.5 and 2 17x11) with crappy tires (I was thinking about using them for burnouts before I put good tires on them). We PM'd back and forth for a few days negotiating a price (settled on $300 + shipping). When I asked what address I should send the check to, I realized he was located only 4 hours from my fiance's parent's house in Indiana. Since I was going to visit her parents for Thanksgiving, I told him I would come pick up the wheels the day after Thanksgiving. He said this was fine as long as I sent a 50% deposit ($150) to hold the wheels for me, which I did.
Fast forward to the weekend before Thanksgiving. I emailed him to confirm that we were meeting up at his house on Friday. He replied the morning I was leaving Maryland for Indiana (Wednesday) saying that he completely forgot but would have the wheels ready for me when I got to his house on Friday. Thursday night rolls around and I email him telling him that I would be at his house around 10am the next morning. He emails me back saying that the wheels are still on the car and that he might not have them off in time. I say that as long as he has a jack and lug wrench, I would be ok taking them off myself. He said this wouldn't work cause he would be in Chicago working, but would be willing to meet me on his lunch break (still a 4 hour drive). Long story short, I say I'd rather not meet cause of too many complications and he offers to ship them to my house. He said he would ship them and when I got them I whould send him another check for $100 (total of $250).
Well, now Christmas has come and gone and I still have not received the wheels. I emailed him Wednesday (Christmas Eve) and he has not replied yet.
Here is my question...I'm done dealing with this and just want my $150 deposit back, how do I legally go about getting this back?
