    Question totaled ws6

    Ok, So my wife totaled (according to ins guy) our 2001 ws6 on Dec 7. I'm no expert but I've been hot rodding for 30 years, and I'm sure it wasn't totaled, Now I ran the carfax and it shows that it was never totaled. and has a new owner. What gives? Any ideas? Do I have grounds for a lawsuit? or am I grasping at straws cause I miss our bird.

    i totaled a 95 bird before and i bought it back from the insurance company and they never marked it as a reconstructed... i was not sure about why they did this but i let it go. I would question them and try to work something out or to see why they screwed you out of a car. Anyway sorry to hear about the loss

    Sounds like fraud to me. The insurance co. took the car, had it rebuilt and sold it to someone else. You might have a case.

    Around here, a totaled car means the repair cost is greater than 75% of the vehicle's value. On a 9 or 10 year old car, its not hard to reach that value. Now I believe normally the title would be labeled salvage and that should show up on CarFax report, I think.
    But I'm not too surprised to hear that someone else fixed it up and is driving it. Body shops and body repair techs do that all the time to make some money. They can fix it cheaper then you and your insurance company can at 'retail' prices.

    Agreed. Your "totaled" and the insurance company "totaled" are two entirely different concepts.

    It varies by state, but here in OK its 60%.

    Talk with vehicle registration. They may not tell you about the new owner but you can ask your questions. Also, not all agencies report to Carfax that a vehicle is totaled. Always remember the info is only as good as what was put into the database.

    Carfax isn't 100% accurate, I wouldn't rely on that alone.

    my '99 was totaled due to a horrific wreck up in dayton ohio. we got her back to TN and like i said the insurance totaled her out. i bought her back because even though her body is badly warped she still has alot of good parts that i'm switching over to my '01. in TN the insurance has nothing to do with what kind of title your car will have after it gets totaled. the state will send you a form and you make the decision yourself on whether you want to restore it so you can get a salvage title (several steps involved to get a salvage title) or if it's just too far gone and you just want to use it for parts (non repairable certificate) i know these things differ from state to state.

    That truly truly s+cks if that car was resold to a scrap yard, resold to an individual and repaired and running around. Do some leg work, it may all be legit, but if it's not, ie no salvage title or some other oddity, then you very well may have a case.
