Work related, think I'm getting screwed

Just got a notice in the mail from work stating that "all objects added to company vehicles, including brush guards, stereo's, cb's, running boards, etc.. are now property of the company and to stay on vehicle" So if I leave, they believe they can keep the brush guard and stereo I put in the truck. I have the original factory parts to replace what I put in. Does this seem fair or right?

That's the plan, but my question is can they legally take your stuff and call it theirs. Isn't that stealing?

Yes, I have the receipts. This question is more for the other guys who work here. I told them I'd see if this was even legal.

One of the guys bought a brush guard for his truck and then they switched trucks on him. He went to take it off and they told him it was the company's now. He said that's fine, I'll turn the receipt in on my expenses and you can pay me back. They said no. They, after this happened, put out this notice.

Told him, If he took it off he was fired.

provided they have the reciepts they are safe... and it is illegal for the company to do that... how ever you should check your company rule book and see if there is anything listed for modifying the vehicles...

Why would you modify something that you don't legally own?

Perfectly legal for them to claim ownership of said aftermarket parts.

It's like this: As example, any document, file, or process that you create (or modify) while working for another entity (company, corporation, etc) is theirs. Not yours. There's no difference between changing the wording on a document or adding a brushguard. The document was theirs, remains theirs. You don't own the word or words added to it.

If you were to put a snazzy paintjob on it, what would you say? That they should reimburse you when it comes time to turn it in for a new one or if you're fired/quit? It doesn't matter if it can easily be taken off or not, you affected THEIR property.

Most companies have a policy forbidding modification of all property, whether it's a laptop or car, i.e. aftermarket parts not allowed.

Besides, they gave you a free ride for how ever long and now you're going to bitch about being out a couple hundred dollars?

    Doesn't matter.

The minute it becomes attached to the truck (or whatever), it becomes theirs. The legal term for it is right on the tip of my tongue, and it's driving me crazy that I can't remember it...

nope... we had an issue like this with my company a long time ago cause driver were breaking shit when installing the stereos in thier trucks... if he has a reciept and their rule books don't say anything about modifying trucks at the time of thier employment they can't do jack unless he signed a paper saying he'd abide by it... plus a small claims court will rule in his favor...

a land lord can't say "well since you're renting the place anything you moved in is now mine"...

    Totally different.

Any changes to the place (paint, drywall, carpet, whatever) proper become the property of the landlord. It's all about 'attachment'.

same thing... not different at all... if i put in a jack for a XM satilite you can bet your ass that it is legally mine...

the things you would be talking about would be something likea new paint job... shit that can not be reversed with ease...

I am almost positive that Tide is right spaz.. The vehicle is under company ownership and I am pretty sure anything you put on it is theres since it is there vehicle. I am interested to see how this turns out though. It would be a good thing to know for sure.

depending on the wording in thier rule book... they can't arbitraily make a rule with out a grace period to remove stuff...

Nope - I'd put the factory stuff back on and be done with it.
