    What Would You Do?

    Well guys i got into a 5 car pile up on the 4th of sep. Some guy in a ford F 150 Decided to plow into me at about 50 mph when i was at a stop. It hurt by the way lol. I was in my dodge ram. Well the stealership said it was totaled but the claims adjuster that came out said they could save it and fix it. My wife was taken to the emergency room because of a headache and whiplash. Now ofcourse a week later my neck is killing me. I dont want to be one of those guys that just gets an attorney for nothing but do yall think its worth it? It was the guys fault that hit me, he was also cited for speeding and wreckless driving. His insurance company are being a Pita, I had to get a rental out of my own pocket..
    Do yall think i need an attorney?

    I think you need to call his insurance company, be extremely stern and firm on your stance in this whole ordeal and tell them that if they do not start cooperating with you more that you are going to get in contact with your attorney and they will be contacted again within 24 hours. See where that gets you first, before you drop the cash on actually getting one.

    Absolutely. Get an attorney. I don't like ambulance chasing lawyers, but this situation calls for an one, especially since you have already said the other insurance company is a pita.

    Yea, there not really working with me, dont get me wrong, i just want my truck fixed and iv got medical coverage for my wife through the military but it feels like pulling teeeth every time i call his insurance people. Either they dont answer and dont return my calls, call me and say there client has a different story, even though i faxed them the police report. I just dont know what else to do.

    Give them an ultimatum. Fix or replace my truck, pay for any medical bills, provide for a rental, and pay for lost wages and/or suffering. If you do that make SURE that there are no lingering medical problems. If it turns out someone was injured (long-term) from the crash and you settle, problems will increase.

    If they refuse, be straight-forward and tell them you will let them deal with an attorney and pay those fees in addition to what you rightfully asked for.

    Lastly, mean it, don't bluff.

    Yes, get a lawyer. Yes, go get checked out.

    My uncle is an attorney. Find someone who you know who will refer you to someone decent, don't do the biggest ad in they yellow pages, billboard or TV commercial. Get one that will be taken seriously.

    If they're already being a hassle and all you're asking them to do is provide you with transportation, they're going to fight you every step of the way.

    Those are things that they know damn well that they're responsible for and the medical bills too. If they're fighting you already, you'll need one eventually unless you're willing to just let your insurances (health and auto) pay.

    By the way, start keeping track of the time you're spending at the dr's office, the mileage, the time away from work, etc.

    There's other things you can sue for, like if she's in so much pain, you're not getting any... you can actually sue for the lack of enjoyment of life and for the hand and foot waiting on her that you're having to do.

    Not all attorneys are ambulance chasers.


    An internet forum is probably not the best place to get legal advice but I would at least see if you could find an attorney that would write a letter to the ins company

    get an attourney right away!!! you could have medical problems years downt he road from this...

    insurance is a tricky thing as well.. depending on limited or full tort... either way your insurance company or his should have provided you with a rental car... do NOT pay for it out of your own pocket...

    make sure you try for a good amount of money as well because you do not know how the injury will affect you years from now... you may feel fine today and then a few weeks, months or even years your find out your hurting and can't go back for money to pay medical bills or perscription costs....

    get a lawyer.
    my friend just went through the same thing, and the first thing she did was got a lawyer. usually an insurance adjuster doesnt argue when a shop says its totaled. its usually better to total the car depending if there was frame damage or what not, so thats kinda weird.

    Hire an attorney & allow HIM to deal with everything.
    The worst thing you can do is run your mouth to the guy's insurance company.
    Let your attorney deal with it, that's WHY you are hiring him.

    Record all your calls and document everything. When you call them Say, Hi, I'm Jeff (example) and I'm recording this call. If you don't say that you won't be able to use it in court. And it makes them much more attentive....

    You're trying to be nice, they are trying to cut their losses by screwing you- You don't think they have a room full of attorneys? They are hoping you will give up and go away cheap- They owe you for your financial loss, time loss, the replacement of your vehicle, medical expenses, and for the loss of your time and transportation-

    Call your local BAR association, and ask for a referal- that way you will get a claims lawyer, not some guy that specializes in contracts or wills. Negotiate whether he will get a flat rate, or a percent of the settlement- sucks to be awarded the value of your truck, then have the lawyer take a third-

    Go to two doctors, specialists, not a GP, and get their long-term prognosis- have that with you when you go to court-

    I am not a lawyer, and this is not legal advice- you need a good attorney for that, so go get one NOW!

    dude wtf??? Get a lawyer asap. That insurance company would've bent you over a barrel 6 ways to Sunday if they'd had the chance. Let's put it this way....if that truck would've hit me I would've automatically fell out onto the ground and started flopping around. Then after I got home I would've placed an order with some sponsors.

    You also don't know if that neck might really hurt like a mofo in 10 years when all the calcium has built up from the wreck......get paid pronto.

    my mom spent 25k out of her own pocket after getting rear ended "lightly" by a white ram van. Thought it wasnt bad, got stiff neck SEVERAL weeks later and then a year later the pain got worse and worse. Ruptured vertebraes! neck problems, surgery, has to sleep with one of those special mattresses and the orthopedic pillows. DONT BE NICE!

    I know all attorneys aren't bad, just the ones who call you after seeing your name in a police report have a bad reputation IMO.

    Anyway, sunset, doesn't your insurance company provide you with a lawyer? Just thought of this, my wife was in a wreck and our insurance company provided one for us.
