Actually, carjacking in many states (including Georgia) does NOT require the victim actually be in the car. In Georgia, it is officially called HIJACKING OF MOTOR VEHICLE, and only requires the car be taken from the immediate presence OR direct person of the one in control of it; it's basicall written much like robbery laws are. I worked a case where a robber robbed a hotel a gunpoint, then took the clerk to the parking lot, robbed the clerk of his keys and stole the clerk's car.... that counts are carjacking. It carries a 5-25 year sentence, with an additional 10 years mandatory to serve if a firearm is used.
