    Got a ticket :(

    For speeding in my dads truck. Cop claims I was doing 44mph in a 25 zone, but it DEF was a 35mph zone where he must have got me because I slowed down the second I saw him and it was like 200ft before it turns to a 25. I contested it and I'm due to go to court in a few weeks. Should I even bother contesting or is it going to be a he said, she said, cop wins, waste of time deal? I could just pay it now and not bother. I mean I cant obviously prove I was in a 35mph zone besides just my word. I'm not exactly the best at describing stuff on the spot either...

    Take a camera or camcorder out and get it all for evidence. Where the signs are, where you got pulled over. Judges like that shit. Best advice I can give.

    I could do this, its only 1 mile from my house but what should I do after, put it on a cd/dvd or just bring the camera in or? I'm actually somewhat good with video and computer stuff so I could do it.

    ok, so you were doing 44 in a 35......still speeding. You can contest the amount over and possibly get your fine reduced but I don't see them dropping it altogther. Who knows though, you show up with your shit together and have a decent presentation and if the judge is having a good day you might get lucky.

    Yea...I'm not gonna lie and say I wasn't speeding, but 19 over looks a lot worse then 9 especially if I get caught again and they check the records. I hope the judge is having a good day when I show up lol.

    A man is stopped by a cop for speeding.

    'Sir, are you aware you were doing 44 miles in a 25 mile zone.

    'Yes,' replies the driver.

    'I see,' says the cop, 'very well I'll need to see your license and
    registration.'

    'Oh, I don't have those,' the driver replies, ' you see this isn't my car.

    'not your car?' says the cop.

    'No, I stole it. Oh hold on, I think I may have seen the registration in the
    glove compartment. When I was putting the gun away?'

    'The gun?' says the cop.

    'Yes, the one I shot the cars owner with. After I dumped his body in the
    trunk.'

    'Let me get this straight sir,' the cop says, 'theres a body in the trunk
    and the murder weapon is in the glove compartment. And this is a stolen
    car.'

    'That's about it,' agrees the driver.

    'Please step out of the car sir,' the cop sir. He then calls for back up
    deciding he needs help with this.

    Before long the area is surrounded with cops, a detective comes up to the
    man. 'I'm told there's a body in the trunk of your car?'

    'No sir,' says the driver. He opens the trunk, no body.

    'What about the gun in the glove compartment?' The detective says.

    The driver opens the glove compartment, no gun.

    'And I was informed the car was stolen,' the detective says

    'Oh,' said the driver handing over the proof that the car belonged to him,
    'who would say that?'

    The detective indicates the cop that called for back up.

    'I suppose the bastard claimed I was speeding too.' The driver said.

    I feel for ya man, got a ticket today in my DD...a 99 Kia Sephia..
    Not for speeding mind you.. For Failure to maintain my lane for 1.5 seconds in each lane before moving to the next lane.. I HAD my directional on.. State Patrol informed me I must maintain my lane for 1000 feet ( approx 1.5 seconds) before changing lanes again..
    I changed three lanes and got a 124 dollar ticket for it..
    WTF over..

    I just got one dropped because the 5.0 didn't show up for the court date. I was lucky. Even if you just get it reduced, you will be alot better off. I Michigan where I live, 19 over is worth 4 points (reckless). Getting some video info with a camcorder is a great idea. Good luck. John

    If it's your first ticket, some states will allow a deferment ( I think that's what it's called) Ask about that.. basically the court will *suspend* the ticket and if you don't get another in a certain time frame.. here I think it's a year it get's deleted.. so no points.

    Represented a young guy earlier today for a fourth driving under suspension charge and a speeding violation. The Judge placed a note on his paperwork when it went out advising him that he had better bring an attorney as he was probably going to jail.

    Upon arriving at the Magistrate's Office, I met with the State Trooper who pulled him over and attempted to plead the driving under suspension charge down to a lesser offense, but of course his past driving record isn't helping things.

    I go back to the room where he and his wife are waiting, and tell him, "Well, it looks like it is going to be 30-45 days in jail..." His face goes ashen, the wife's jaw drops, and I say, "Hey, just fuckin' with you, we got it dropped down to a driving without a license. No jail and no suspension!" I couldn't resist... The guy lucked out and happened to be pulled over by one of our "nice" Troopers.

    Moral of the story (besides "lawyers are assholes" ) is that it never hurts to try. The worst that will happen is you get convicted of the offense as charged and may have to pay some additional court costs. I am able to plea bargain approximately 85-90% of the traffic cases I do. Biggest impediment to a deal is someone who is a jerk to the Trooper at the time of the stop.

    Well thanks guys, I'm definitely going now even if I probably will lose, just for the experience (lol). Started looking close at my papers and the ticket doesn't have circled what way the officer caught me speeding, and then my court papers say between 15-19mph over the limit so I'm almost wondering if he even used his damn radar lol.

    Not sure in your jurisdiction, but here it goes something like this if you can not work out a deal and it goes to a hearing. The burden of proof is on the state to prove the offense and the following must be established:

    1. Date, time and place of the offense.
    2. Identify the speed zone in which you were travelling, ie. posted 35 mph.
    3. The manner your speed was clocked (radar, vascar, etc.).
    4. That the unit you were clocked with had been calibrated within 60 days of the stop.
    5. The officer must have a certificate from the testing station and the unit serial number on it must match the unit listed on your ticket.
    6. Testimony that the testing station is certified to calibrate the unit.
    7. Must testify to the speed you were clocked at.
    8. Must identify you as the driver of the vehicle.

    Absent any of the above, courts in our jurisdiction will throw out a speeding citation. Let us know how it turns out.

    I was a MP for 4 years. A trick question that will get you off the hook, worked for me when I got pulled over 88 in 55. If they use radar (won't work with laser) The radar is usually calibrated twice a year by a state official. The police test the calibration by using 2 tuning forks (35mph/65mph)

    Ask the police officer on the stand if he calibrated his radar, if he says yes......BINGO your off. He can't calibrate but only TEST the calibration.

    Learned that in when I became RADAR certified in the state of GA. And worked for me in WI

    Somethings to know about radar:

    A: Radar is not very accurate in heavy rain
    B: Radar will reflect the speed of the biggest and most dense object. For example, if you are running next to a 18 wheeler, 9 out of 10 times it will show the semi's speed.
    C: Radar can't be used with defrost blasting, throws off the reading.
    D: Radar is not very accurate by bridges
    E: Radar is not very accurate in fog
    F: Radar is not very accurate when cars are going around corners, slight bends.

    Using these tools to your advantage plus the video tape, will get you off the hook. Like I said, it worked for me and on top of that, I got a buddy off on a 87mph in 65mph
