There is nothing wrong with adepartment issued firearm. The problem was that he was wrestling around with the weapon in his hand and probably ended up with a double feed or a stovepipe.
What this guy should have done is wait for backup before searching/pulling the guy out of the car. He should have shot him WAY earlier too.

That was pretty funny. I really lost it when I saw the guy chasing the suspect! Talk about a turn around.
