If the cop dont show they cant prosecute if they have the paper work or not at least that the way it usually works were I live, so if it was me I would fight it and hope he doesnt show to court.

They are always going to use the scare tactics on you... don't ever believe a word they say. Whenever anything like this happens... get a lawyer immediately. Yes, they will bleed you dry and take all your $$$, but its usually worth it.
Small town or not, your prob looking @ community service, losing your license, a big ass fine, and a future full of high insurance premiums. I would fight this all the way (got make sure your bud does too, if he pleads no-contest or guilty and signs an affidavit, that he was racing "you"... which they will try their hardest to make him do; not even Johnny Cocheran will be able to get you off)

fight it dude, recenly my dad was involved in that crap, apprecantly some old bagg said he had hit her and ran off, so recenly my dad got a call from the people he hauls with and hes going to take his truck tommorow to take some pics, apperently; she said my dad hit her door and that somebody pulled over and gave her the license plate of his truck. (total fraud) even though shes the mother of a cop (why are there such stupid people in SA that bitch shouldnt be driving anyway she has all kinds of healt problems and probably doesnt even see) the funny part of this is that his truck is high and the lady was on a small car lol; however we cant sue because even though its slander she is protected by the first amendment, which i dont get that she's protected because she made a false claim.

Im gonna talk to my mom tonight about getting a lawyer. And no, his plate wasnt lawdog haha. Hopefully the person that gave him my plate number doesnt show to court and it gets thrown out.

I almost call bullshit on that.. the cops camera isn't rolling 24x7 i'm pretty sure
they will LIE and LIE and LIE to get you to conform to whatever works out best for the cops in court. Get the lawyer, no evidence or witnesses (likley the snitch won't show) gets dropped

see if you can get deferred adjudication. If you don't get anymore tickets in 90 days or 6 months or something, it won't go on your record and your insurance won't go up. That's what i got for my first offense. Now i just take defensive driving and they stay off my record since I get a ticket about once a year. Never pulled over for racing, though, so that might be different

The best bet is to just man up and say you made a stupid mistake. The judge will be a lot more lenient; everyone I have ever heard make an excuse (I have been to traffic court a lot, I used to be a Police Officer in Texas) has lost. Those judges have heard it all. If you try to plead not guilty and the Officer/Deputy/Trooper really does have a tape you will get off worse because you will look like a liar and you will be more likely to lose your license. If you present yourself as honest and apologetic you will make out alright.

The cameras on those cars run constantly and are saved into the hard drive on the computer in the car. So it is entirely possible that he has it on tape. All he has to do to pull up the footage is rewind the DVR to the time the incident took place and save it. So he is probably for real...

wether he gets your speed or not.. he can write you a ticket for exhibition of speed.. it basically means you picked up too fast...
and for the he cant get you for it later.. any one of us.. or any officer has 1 year to file a report on an incident.. so yes you could recieve a ticket for burning tires in a parking lot 6 months earlier.. but they have to know without a doubt it was you... usually doesnt happen, but if they want to...

Hawk23, thanks for the idea, im really gonna push for that too, i never even thought of that!
But wooddaniel, im thinking the same way. Im hoping that if really show some remorse and ask him to give me my punishment in other ways then i may get off with a reduced charge. Providing he is in a good mood that day..
Quick question though guys, how long do point stay on your license? and also my mom said we just switched insurance yesterday and that checked our records already. She is saying that they dont check but every 2 years or so, and randomly in between, so if this does go on my record, will it go unnoticed for awhile?

my insurance company NEVER checks my record... so it depends on teh company...i have state farm.....in nys points stay on your license for 3 yrs

Mine doesn't either unless I give them a reason to rerun my policy. As for this guys case however he is under 20, so they might rerun his policy every year to see if the rates drop as he gets older as he should get a discount for hitting certain age markers, 20, 21 etc....so he might get caught. Once you reach a certain age you stop getting those discounts, for mine it was 25.

If your buddy rolled over, that's tough and will complicate things. GET A LAWYER. You will save money in the long run. Period. Listen to the guys here. GET A LAWYER. Take it from a dude that's been there. STFU. Lawyer up. and Plead Not Guilty. DA, Cop whatever, will tell you it will go easier if you confess. What they mean is.. It will go easier on THEM.
