Dude, I sold a hypertech about a year ago on ebay and done the same thing as this guy did to you. He called me and I paid for the mistake. He shipped it back to me, I unmarried the hypertech from my car, sent him the Hypertech back with a refund for his time, shipping, and trouble. It was my mistake. Just try giving him a call and explain kindly to him your situation and you may get lucky. However, if that doesn't happen, you will need to get the vin number the HPII is married to and have someone program your car with something like HPTuner with that vin number into your computer so you can use it.

I think you're out of luck. It's now locked with the VIN code of the original car that it was used on.The original owner should have gone back to the factory tuning parameters, which are still in the programmer, before selling it.This unlocks it,and allows it to be used on another car.
Try contacting Hypertech to see if they can clear it for you.

When you call them, be polite... but persistent. They don't enjoy re-flashing an item that they lost a sale on (they might ask for the receipt). If the seller has very good feedback, I'd make it a point of reaching out to him, initially, then threaten to go straight to eBay if he doesn't comply.
