I would certainly think it is your word against his, especially since I do not know what the standard of being "unable to operate vehicle with top care" is.

I would suggest, and this is not meant to be a dig at you, but if you speak the way you type it may be in your best interest to have someone like a lawyer to speak on you behalf.

Speed can be visually determined. This is pretty much proven and allowed especially if the cop is radar certified. It's a requirement of radar certification that you be able to visually estimate speed within 5mph. You can get pretty good at it, trust me. If your tires even chirped your done. I suspect the charge is reckless driving. If you think your right, it never hurts to go to court. The fine is the same either way. The judge might let you go to traffic school too if you talk nice. Then there's always the chance that the officer won't show up in which case you win automatically. This is how it is where I am, where you are might be different.

    My life is a
    Ben Stiller movie.

either go to traffic school or take it to court. court normally costs less, but cuts into the day time [during work] where as traffic school is pricey but atleast its at night, it's only good for 1 "get outta jail free" card per year though; so use it wisely. I suggest court. Mebbe the judge can sort this out, normally if it's your first offense they are nice; mebbe he'll knock it down to a noise disturbance or something w/no points and a small fine.

No, you can't accurately measure speed based on visual alone. Thats the biggest load of crap I've ever heard, there is no way to prove that the officer's guesstimate is even remotely accurate. They are cops, not machines, they cannot estimate velocity any better than any other human being can. A ticket like that should get thrown out in court immediately, its retarded.

If his tired chirped he's done?? What is this, Nazi Germany?? If you chirp your tires while accelerating, in no way is that speeding, reckless driving, or failure to maintain vehicle. It just means you accelerated slightly harder than was required to get the vehicle moving. There is no law against rate of acceleration.

    I can't stand cops.

You know not of which you speak, Wesman. Speed can be, and routinely is, visually estimated. Again, if your radar certified, you can do this. I am, and I can within 5mph. The last schmuck that came to traffic court disputing this learned the hard way. In most places, the laws defining reckless driving define one part of the offense as "any loss of traction" ie., the loss of traction that occurs under heavy acceleration which often causes the tires to chirp or bark. Also, there are rules governing acceleration and it is called "exihibition of speed". If SilverZ was out driving like a JackHole and got a ticket, well, thats life. If he thinks the cop was wrong he can go to court. Don't show up claiming that an officer cant visually estimate speed and don't show up claiming that "I only chirped the tires a little", thats a sure recipe for a loss in court and a fine. Oh, yeah, sometimes we can't stand ourselves either.

Wow, you sound like a real badass, teaching people a lesson about taking you to court

I'd love to see you try and "guesstimate" my speed, here in NJ you'd be laughed out of court. See, we have this thing called "common sense", and that goes against the principle that you can accurately "visually estimate" someone's speed. If you don't hit someone with radar, you shouldn't be able to give them a speeding ticket, simple as that.

I hate cops like you. Find something better do to than screw over drivers for trivial bullshit, you should be transferred to Newark or Camden, you'd leave with a different perspective on life and law enforcement, and what really important. "Traffic enforcement" is nothing more than a revenue generating scam, everyone knows that except for you, apparently.

Whatever dude, your the obvious genius here. I got used to the brilliance of street lawyers years ago. The fact is that something like fourty thousand, (yes 40,000) people are killed each year in motor vehicle accidents. Motor vehicle's are not toys and the street is not your fricken playground! I will take each and every opportunity to take some retard off the street in the hopes that someone doesn't get killed by one of these jelly-brained imbeciles, if even for a short time. Don't condescend to me telling me I don't know my job and don't know what's important. When you have to scrape some kids brains off the tarmac at 2am because he and his idiot friends were out street racing you can come talk to me about what's important. I've been doing this long enough to know what I'm talking about, I've seen the bodies. Up until the point you can offer something intellegent or enlightening, you are hereby consigned to the ash heap of internet loudmouths. Cya.

Actually there is a law about excessive acceleration. My sister got a ticket for it.

ok, called a lawyer and it is better just to have him fix it. the problem is even though i beleive i didnt do anything wrong the judge always favers the cop especially in the city i got the ticket. my word vs his .... not goood for me.. and either way i would still have to pay court cost even if i did win which in that city is about $200. and if i get the lawyer for another $50 im really not taken any risks. By myself if i loose then my insurance

average joes odds on winning this

There is a big difference between chirping your tires at a stop sign and street racing in at 100+MPH and crashing. If you can't recognize the vast difference between those things, you should turn in your badge now, because you're just doing a disservice to good drivers everywhere.

Yeah, you can never get good at anything, even if you practice 8 hours a day. Why bother practicing jump shots, or shooting off a jump on skis, if you can't learn a skill.... Maybe if you ever sat next to a road for more than a half hour you would figure out how stupid this sounds, not to mention to see how many bad, self-important rude drivers there are out on the highways.

Cops end up being considered expert witnesses, and their word is usally taken as un-biased, because, generally they don't know you and have no personal stake in trying to "get" you. They are doing a job that society tasks them to do, try and regulate bad behavior on the highway. Learn the lesson, pay the fine, and move on- or, be stupid, and get lots of tickets- I don't care. Sooner or later, you get so many tickets and suspensions that you can't afford insurance- then, maybe you stop driving like an ass. Maybe not, keep driving without license and insurance- then whine about how unfair it is when you get to spend some quality time with Bubba in county lockup. Most people eventually figure it out, but, obviously, not all of them. Some people are just convinced that they are "special"

just received a ticket, for 10 over... The officer says he paced me.. altho I saw him come up from behind three lanes to my right from behind, move around the traffic I just passed and slide in behind me...Do I think it's BS ... Yes.. Is the cop an utter ass ? No.. He saw me pass on the right..and altho I wasn't hauling ass, I was in the wrong..
I agree that officer's have a shitty, unapreciated job.
AND I was and still am annoyed that I got the ticket..BUT when I see three imports zigzagging in, out and around traffic at speeds that FAR exceed the flow AND see them detained to talk about their choices I agree that OFFICERS are needed. Are they perfect..? No. They are human.. But for someone to make a blanket statement how they all suck... WTF.. Do everyone a favor and sell your internet connection..I didn't see you coming to my wife's rescue when some Ass in a Denali rear ended her an fled.. I didn't see you coming to my home to take pictures and statement nor calling at 10 pm to inform us the perp had been arrested. an OFFICER did.. and off shift too.
I may not agree with them sometimes BUT DAMN I'M GLAD THEY ARE THERE.
