why arent they covering your car? wreckless op? and how can they not cover the other car? thats what liability is, and thats why its required by law. and that does suck about your car, but i feel bad about the other car. sucks for him, he wasnt dicking around.

my gf hit a parked car superbowl sunday. totaled her car and she only had liability. then again, she had a 97 escort with 170k on it

Have you heard from the other party yet? I wouldn't put the cart before the horse if you know what I mean. Maybe they are decent people, and if you can work something out, out of court, all the better. I don't know what your credit is like, but if you can swing the $$$ on a credit card to have their car fixed, I'm sure that's all that really matters to them.

Then you can pay off the amount over time. Since the car was parked, thank God there's no room for personal injury!

My wife got rearended and the other parties insurance wouldn't cover it as his policy had lapsed by two days. The fella was pretty decent and worked out a payment plan with my insurance and they covered the damages after getting together his agreement. It was the right thing for him to do since he was in the wrong and you don't see that often anymore.

Eric, times are tough. The person you talked to is likely entry level. Call back and demand to know the paid to date. You should have 3 months from this date before you lapse, and they need to send a letter stating it's ended. If you find what they have done to be questionable tell them you will report them to the department of insurance.

Well the insurance caompany by law has to notify you before they cut you off. They are also supposed to inform DMV. If you were not properly infromed, maybe you can get them to pay it!?!?!? I would call and ask to speak with a supervisor. What company is it?

Let's say your paid to date is January 1, 2009. That means you payed through December. You would not lapse in coverage until April 1, 2009. What will happen is that entry level person looks at this and reports to someone else. That person who is slightly higher up tells them to tell you that you don't have coverage. Like I said times are tough. They are banking that you accept this. If you haven't asked the right questions they'll roll right over you. Call back and demand the facts. If they won't give them to you call the department of insurance in your state. Chances are that you are covered. If I'm right you'll be speaking to someone else right away. Don't let them rush you off the phone either. Tell them you will call the DOI right after you hang up if you don't get some answers.

It may possibly vary in your state but I doubt it. Also if they try to tell you they sent the letter and that it did lapse demand a copy of the letter, with the date it was mailed, for your own records. They may have fouled this up too.

I could be completely wrong about this and auto insurance lapses right away, but it's worth a shot to hassle them and find out the answers.
