Lawsuit alleges he posted photos on site that solicits photos of ex-girlfriends

A Chicago woman says she was mortified when a high school friend said he had spotted nude photos of her on a Web site, according to a lawsuit filed Wednesday.

The woman instantly suspected her ex-boyfriend, who had taken the photos but promised -- even after their February 2006 breakup -- that he would keep them private, according to the lawsuit filed in Cook County Circuit Court.

But the ex-boyfriend, Miles Marsh, secretly posted the photos on the site that encourages men to post nude photos of ex-girlfriends, according to the suit.

The suit claims Marsh intentionally inflicted emotional distress on Jessica Voth and invaded her privacy by posting the photos online without her knowledge or consent.

Voth says she was informed about the pictures by the classmate last November. The suit seeks unspecified compensatory and punitive damages.

Attempts to reach Voth and Marsh were unsuccessful.

Both are valid claims IMO -- doesn't mean she will prevail, but it should be interesting.

ips can be faked...and mac address also..it is really hard to prove he did it...

however..the person who owns\has the service in their name is therefore responsible for anything that comes from that ip..so in a nutshell ..if it is his ip..he is still responsible.

I thought this came up before. If he took the pictures with her consent, they are his property and he can do with them what he wishes.

Now, like anyone she has a right to sue him but I doubt it will go anywhere.

Though I think people usually shouldn't post pics of private citizens without their permission, if she didn't make him promise in something resembling a written contract, she does not deserve damages. Otherwise, as was pointed out, if he took the photos with her consent, it's his legal right to post them. It seems she was stupid. Probably stupid for letting him take pics in the first place, also. If she dumped him in a cruel way, then haha, she deserves the humiliation.

unless he is getting some sort of income from them or she was underage she has no right to sue him and it will be dismissed...
