Tragic deal all the way around. I think the prosecutor did what he pretty much what he had to do by pushing it to a Grand Jury to make his decision for him and to protect his own interests in the county he lives in. After all, it is election time in November.

It was tragic but I don't see how he could have been held liable. Looking out for pedestrians was the last thing that was on his mind at the time.

Just seen on the news the family is not happy with the decision and "will persu all avenues to bring justice for Kevin". It was a terrible thing that happend and I feel for the family as well as Tony but you got to be kidding me that they are going to push this! Assholes just want money. Like to see how that works out for them seeing how he tested Hot!

yea they want money, not question about that one...I feel bad for everybody involved, but after finding weed in Ward's system I think the family just needs to drop it and try to move on. That at least somewhat explains why he was stupid enough to run into oncoming traffic on a race track...sounds like an open and shut case if they decide to push the issue "thats if it can even be brought in front of a judge again". Its a bad situation all around, but like I said in the beginning...the only guy breaking any rules was the guy who got out of his car and ran towards moving race cars.

Didn't know the guy had marijuana in his system, but that doesn't mean he was high when racing. Shit stays in the body for 30 days or more depending on how much he smoked.
This alone will get it tossed out of court.

I understand it can stay in your system...but it sounds like he actually smoked some before the race and that it was enough to make people go "well this changes some things..."

I'm going to draw on some knowledge gained from the OJ Simpson trial.......the family will most likely pursue this in civil court instead of a criminal court. Tony will pay them some money just to end it at some point or out of guilt. Personally I would counter sue them but I'm a dick that way.

Haha I dunno man...sounds to me like the guy had a death wish. I don't know that the weed even matters in all honesty, but it would look really bad in court for the family if they decide to press this...I wouldn't want the media publishing that my son was a pot head who got himself killed because he was an idiot but I also wouldn't be trying to make money off of it like they are either...they might be ok with his name being drug through the mud if they get something out of it.
