    Unhappy My Z28 Is going..(Sorry so long)

    This is a very unique and Sad day.I may have lost my battle with the finance company.I have been out of work on several work comp injuries due to my past job,I have won all three cases and the Insurance co committed to the case(Ongoing since 03-05-04.Two arm surgeries,two hand surgeries,six nerves,and a pending Back surgery soon to be scheduled this Friday!(and yes ...I have an Excellent Work comp Attorney!)Since all of this I have lost my House,and all of my Extra curricular activities(R/C airplanes,my collection of IGT and Bally slot machines(Exact ones at the casinos).All the above were sold to accumulate money for myself,Wife and two kids..and to secure a townhouse on a lease until I can return to gainful employment again.The past year included filing a chapter 13,turning that into a chap 7,and buying time so that my TTD payments could start(They did,but too late)I am now able to make our bills,with enough money to live pretty good,all with my back being treated and fixed.Today I got a call from one of my Attorneys stating that we can no longer hold off the finance co!They have filed for an acceleration of the contract for the amount of 31,000(yes Thousand)and are in the process of a replevin act!I am no longer protected under the b.k. laws,and due to the new laws,a chapter 13 will not help!(They will be granted the 31,000 they are asking).During all of this,I have called them and offered a repayment plan(Due to the value of the car),It is a 2000 Z28...mint!!Tire and Wheel mods,and a showroom condition car with under 40,000 miles!I tried to explain my situation to no avail..I even offered tthem current blue book value (cash)and they want it back..(several attorneys told me to not even think about their reasoning!!!)Figure asset recoverey fees,storage,auction...they will lose money!!They are doing this out of spite!We have fought this long and hard..My wife has been supportive up till now..and I know it is just a car..but I have alot of time,money,and effort into my car,and it has been with me for a long time...(I will miss my car)...I have to vent,andI appreciate any input.I will call them one last time..and maybe they will have a change of heart...but at least I will go down swinging.Thanks for any advice or info that any of you guys have....My wife still says ...Its just a car....But you guys know how I feel on top of all my other health problems,I just did not need this too!! P.S. I will probably have my Wheels and tires for sale soon...they can pull it out of here on the rotors...to shit with them..

    Part that shit out man. I say screw all the insurance companies, banks, and any other creditors that like to jack interest rates through the damn roof. Bastards.

    I thought about that too!I would like to see the look on their face,when they come to get it and all there is to look at is a shell.Legally I am not responsible for any deficit that they incur,because my chapter seven protects me!My wife and I were just talking about this a little bit ago..There might be a whole bunch of parts for sale soon!!!!!Including engine and trans!!!!

    I also thought about temporarily removing Engine and trans,letting them come out and verify that I am so-called rebuilding engine.......What gets me is that you try and do the honest thing and let them know that I am not trying to avoid them and I want to pay my debts...But I had no income at the time!!Now I do ,and they got me by the nads!! I swear,honesty does not pay sometimes!!

    Thanks for the offer..but at this point I am only delaying the unavoidable.If they succeed with the replevin,the courts will nail me with the 31,000 until the car is in their possesion.Unless the above other options take place!!

    and Mod. your friends an idiot. when they do repo and sell the car, he's only going to owe that much more on the deficiency balance. either A. sell the car outright and work out a deal with the lien holder. OR B. Just tell them where to pick it up. So much is avoidable when u really think about it. Its not the banks fault, their only trying to recoup on the money they lent you and then when you default on the loan it's may seems like its everyone's fault but your own. Sure we all have shit happen to us that is beyond our control, but when that shit happens, come to terms with it, be a man, and deal with it. Use common sense.

    They also can report the car stoeln if you refuse to hand it over. Doubtful mod friend is even able to drive the car around because they still have the title and that would make it impossible to get is registered.

    This is kind of off the subject of the car but giving you my .02. DO NOT HAVE BACK SURGERY UNLESS YOU CAN'T FREAKING MOVE!!!!!! I had my first back surgery in '87, when I was 17. I have had 5 since and I live in CONSTANT PAIN! I can't work (still fighting with disability, even though their specialist says "there is no way I can be productive in the American work force") and live on a mountain of pain meds that just barely take the edge off! I haven't had a pain free day in almost 20 years. Having the fusion in 2000 was the biggest mistake I ever made, was hoping it would help with the pain but only made things twice as bad! Not sure what your diagnosis is, but mine was degenerative disc disease (herniated disc, slipped disc). Please try all other alternatives before having the surgery. I wouldn't wish the pain I live in daily on my worst enemy. Best of luck to you though, not being able to work really sucks!

    If the car is missing parts they will charge you for the parts missing unless you bought these parts yourself and can show proof. Like say you bought a factory ls1 because the old motor blew its your if you have a reciept.

    I would hand it over just let it go. Heal yourself, and try to start life all over again.
